Federal Bankruptcy Rule Amendments effective 12/1/2018

Wednesday, November 28, 2018

On October 4, 2018, the Court posted a redline version (with Committee Notes) of the expected 12/1/18 federal bankruptcy rule changes. We have an additional educational aid to share: FRBP Rule Changes, and also want to point out two additions to our ECF dictionary that are a direct result of the 12/1/18 amendments. First, a new event under "Motions/Applications" called Determine Validity of Payment Change. This event is to be used by any party that wishes to file a motion under new FRBP 3002.1(b)(2) to determine whether a proposed change in payments under Rule 3002.1 is "required to maintain payments in accordance with sec. 1322(b)(5) of the Code." Second, a new event under "Appeal" called Supplemental Statement Re: Certification of Direct Appeal. This event is to be used by a party that wishes to file a supplemental statement pursuant to FRBP 8006(e)(2).
