Notice of Procedural Change—Creditor Matrix

We wanted to provide you with advance notice of a procedural change relating to the Creditor Matrix that the Bankruptcy Court Clerk’s Office will be starting in March.
Historically, our Local Rules made a distinction between an Amended Creditor Matrix and a Supplemental Creditor Matrix. However, the modifications made to the Local Rules earlier this year have eliminated that distinction. Going forward, the Clerk’s Office will no longer distinguish between an Amended Creditor Matrix and Supplemental Creditor Matrix; there will only be an Amended Creditor Matrix.  

D. Me. LBR 1009-1(a) requires that any amendment “adding creditors shall be accompanied by a list containing only the names and addresses of the additional creditors.”  If this list is not included with your amended schedule, you will no longer receive an Entry regarding the need to file an Amended Creditor Matrix. Instead, the Clerk’s Office will review the amended schedule, add any new parties to the CM/ECF Creditor Listing, and docket a Notice of Clerk’s Fees Due in the amount of the amendment fee (currently $34).  This practice will be in place for all amended schedules that may add a creditor/party to a case (Schedules D, E/F, G, and H).

For example, when you file an Amended Schedule G to add a landlord but do not include an Amended Creditor Matrix, you will see a Notice of Clerk’s Fees Due docketed for $34 that’s linked back to the Amended Schedule G. This fee represents the modification to the Creditor Matrix that the Clerk’s Office made behind the scenes, and you will no longer be prompted to file the Amended Creditor Matrix. Likewise, if there are any creditors/interested parties listed on the schedules at case commencement that are not included on the original Creditor Matrix, the Clerk’s Office will add those creditors/parties to the CM/ECF Creditor Listing and docket a Notice of Clerk’s Fees Due.  Again, this fee represents the modification to the Creditor Matrix that the Clerk’s Office made behind the scenes.

While it is our preference that Amended Schedules be accompanied by an Amended Creditor Matrix in compliance with the Federal and Local Rules, we wanted to give you advance notice of this change to reduce any confusion.
