Local Rule Amendment

Local Bankruptcy Rule 9045-1 has been amended. The rule as previously written allowed parties to continue matters without filing a motion if all parties to the matter consented. The new rule adds three limitations to that ability. First, it permits only two such continuances. After using the continuance twice for a given matter, parties will have to proceed by motion if they want a third continuance. Second, it requires that any continuance sought under the rule be filed no later than 4:30 PM on the day before a scheduled hearing. And third, no continuance sought under the rule shall be for a period of more than forty five days.
