PROPOSED LOCAL CHAPTER 13 PLAN FOR THE DISTRICT OF MAINE

 

Effective December 1, 2017, each federal judicial district will be required to use a single, official Chapter 13 form plan for that district. Fed. R. Bankr. P. 3015(c) (proposed, effective 12/1/17) (“Form of Chapter 13 Plan. If there is an Official Form for a plan filed in a chapter 13 case, that form must be used unless a Local Form has been adopted in compliance with Rule 3015.1 ….”). In the District of Maine, the Bankruptcy Court Local Rules Committee appointed an ad hoc national chapter 13 plan committee for the purposes of evaluating the new Official Form 113, Chapter 13 Plan, and making a recommendation about using the national plan or instead drafting a local plan for the district. After two full days of meetings and many more hours of review, comment, and discussion, the result of the committee’s work is proposed Maine Bankruptcy Form 2, Chapter 13 Plan.

Following the committee’s recommendation, and in compliance with Fed. R. Bankr. P. 3015.1 (proposed, effective 12/1/17), the Bankruptcy Court for the District of Maine intends to adopt a local plan. By this notice, the Court seeks public comments on the local plan, through Wednesday, August 2, 2017.
